These Terms of Service (“Terms”) govern your use of By Any Means Business’s website, programs, and services. By accessing or using our platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old or have legal capacity to enter into a binding agreement.

If under 18, parental consent is required.

2. Services Provided

By Any Means Business offers consulting, marketing, automation, and backend systems for sports coaches, trainers, and related businesses. Services may include:

▪️CRM setup and automation workflows

▪️Websites, funnels, and business audits

▪️Subscription programs and community access

The specific scope of services will be outlined in your individual service agreement.

3. Fees & Billing

Recurring Payments: Subscription fees are billed on a recurring basis (e.g., monthly, quarterly, or annually) as specified in your agreement.

One-Time Fees: Certain services, such as setup, customization, or transition support, may require one-time fees. These are due upon commencement unless otherwise agreed in writing.

Late Payments: Failure to pay on time may result in suspension of services until payment is received. Late fees may apply.

Refunds: All payments are non-refundable unless otherwise stated in your signed agreement.

4. Account Registration

Some features may require account creation. You agree to provide accurate information and keep your credentials secure.

5. Client Data & Intellectual Property

Client Data Ownership: You retain ownership of all business data entered into BAM systems (contacts, leads, communications, customer records, etc.).

Data Export: Upon request or termination, BAM will provide a standard export of client data (e.g., CSV, PDF). Proprietary configurations are excluded.

Intellectual Property: All templates, workflows, automations, and proprietary materials remain the exclusive property of By Any Means Business. Clients are granted a limited license to use these materials during active participation. Duplication, reverse-engineering, or replication is prohibited.

6. Confidentiality

Both parties agree to maintain confidentiality of sensitive information disclosed during the course of services for a period of two (2) years.

7. Termination

BAM may suspend or terminate services for non-payment, breach, or misuse.

Clients may cancel services per the terms of their individual agreement.

Upon termination, client access to BAM systems will cease, but client-owned data remains theirs.

8. SMS Messaging Terms

By providing your mobile number, you agree to receive SMS messages from BAM. These may include scheduling updates, promotional content, and system alerts.

9. Results Disclaimer & Limitation of Liability

BAM does not guarantee specific business outcomes, revenue increases, or lead generation.

Results depend on client implementation and use of provided tools.

BAM’s total liability is limited to the fees paid by the client in the three (3) months preceding any claim.

10. Non-Solicitation

During the term of services and for twelve (12) months following termination, clients agree not to solicit or hire BAM employees, contractors, or partners involved in providing services.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Disputes will be resolved in Miami-Dade County courts.

12. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
